Indiana Lemon Law Blog: Does It Matter Where I Bought My Car?
If you recently bought a new car and have discovered it’s a lemon, your first step should be to contact a lemon law attorney. However, where you bought the car may determine where you need to search for an attorney.
If your car has been in and out of the repair shop multiple times and despite their efforts, you’re still having problems with it, you might have a lemon. However, if you currently reside in one state but bought your new vehicle in another state, you may be wondering where you must file your lemon law case. How do you know which state lemon law applies to your vehicle?
Lemon Laws Vary by State
In general, each state has its own laws that define what a vehicle is under the particular law. In Indiana, a “motor vehicle” or “vehicle” means any “self-propelled vehicle that has a declared gross vehicle weight of less than ten thousand (10,000) pounds” that’s used as a personal vehicle. If that’s you, the key to understanding which state law applies to your vehicle lies in the specific location of your purchase. Indiana Code 24-5-13-5(2)(A) and (B) specifically requires that in order for the Indiana Lemon Law to be triggered, the car must be sold to either a “buyer in Indiana and registered in Indiana” or a “buyer in Indiana who is a nonresident” defined by Indiana Code 9-13-2-113.
In other words, in order for the Indiana Lemon Laws to apply, the vehicle must be purchased in Indiana, but it generally doesn’t matter where you reside once you purchase or lease your vehicle.
